1. What HatuaAfya is
HatuaAfya is a booking and practice-management platform used by independent clinics, hospitals, and doctors across Kenya. HatuaAfya is not a healthcare provider— we don't practise medicine, employ clinicians, or take responsibility for the clinical care you receive. That responsibility sits with the specific clinic or doctor you book with.
2. Medical emergencies
HatuaAfya is a scheduling tool, not an emergency service. If you are experiencing a medical emergency, go to the nearest emergency room or call emergency services immediately — do not wait for an appointment or a response through this platform.
3. Accounts
You're responsible for the accuracy of the information on your account and for keeping your password confidential. Doctor accounts fall into two categories: those added by an existing clinic (verified at creation, since a real clinic is vouching for them) and those created through self-service sign-up (shown with an "Unverified" badge on public pages until reviewed by our team). We encourage you to check a doctor's verification status and independently confirm their registration with the Kenya Medical Practitioners and Dentists Council (KMPDC) or the relevant professional body before relying on their credentials.
4. Bookings and payments
Appointments booked through HatuaAfya are agreements between you and the clinic or doctor — cancellation, rescheduling, and refund policies for the appointment itself are set by them, not by us. Payments made via M-Pesa or card are processed by Safaricom and Paystack respectively; HatuaAfya does not hold your funds.
AI credits purchased by a doctor never expire, are non-transferable, and are consumed only when the doctor actively uses an AI-assisted feature — see our Privacy Policy for how that data is handled.
5. AI-assisted features
Any AI-drafted content on the platform (such as visit-note drafts) is exactly that — a draft. It is never saved or relied upon until a doctor has reviewed, edited, and explicitly approved it. HatuaAfya does not warrant the clinical accuracy of AI-drafted content; the reviewing doctor is solely responsible for what they ultimately record and act on.
6. Doctor and clinic obligations
If you use HatuaAfya as a doctor or clinic, you confirm that you hold any licences required to practise, that the information on your profile is accurate, and that you will handle patient information in line with the Health Act, 2017 and the Data Protection Act, 2019.
7. Acceptable use
Don't use HatuaAfya to impersonate someone else, submit false medical or identity information, interfere with the platform's operation, or attempt to access another user's account or another clinic's data without authorisation.
8. Limitation of liability
To the extent permitted by Kenyan law, HatuaAfya is not liable for the clinical care, advice, or outcomes provided by any doctor or clinic on the platform, or for losses arising from a scheduling error, payment dispute, or service interruption beyond our reasonable control.
9. Changes and termination
We may update these terms from time to time; we'll update the date at the top of this page when we do. We may suspend or terminate an account that violates these terms.
10. Governing law
These terms are governed by the laws of Kenya.
